These Terms and Conditions constitute a legally binding agreement between you and BeThere Group Inc., a Delaware corporation, governing your access to and use of the BeThere platform, including all websites, mobile applications, software, artificial intelligence concierge systems, integrations, and related services.
By accessing or using the platform, you agree to be bound by these Terms and Conditions. If you do not agree, you may not access or use the platform.
1. Nature of the Platform
BeThere Group Inc. provides a technology platform that enables users to discover, request, and book hospitality-related services and experiences offered by independent third parties. BeThere provides software and technology services only and does not provide, own, operate, control, or manage any third-party services or experiences unless expressly stated.
2. Independent Third Party Providers
All services available through the platform are provided by independent third-party providers. Such providers are independent businesses and are not employees, agents, contractors, or representatives of BeThere Group Inc. BeThere does not control, supervise, or direct the services of providers and shall not be liable for the acts, omissions, negligence, or conduct of any provider.
3. Eligibility
You must be at least eighteen years of age and have the legal authority to enter into binding agreements to use the platform. By using the platform, you represent and warrant that all information you provide is accurate and that your use complies with applicable federal, state, and local laws.
4. User Accounts
You may be required to create an account to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. BeThere reserves the right to suspend or terminate accounts at its sole discretion.
5. Bookings and Services
The platform allows users to request and book services from independent third-party providers. BeThere does not guarantee the availability, quality, safety, legality, or performance of services. Service providers are solely responsible for delivering services.
6. Payments
You agree to pay all charges associated with bookings made through the platform. Payments are processed through third-party payment processors. BeThere does not store or control payment card information and shall not be liable for payment processor errors, failures, or security breaches.
7. Cancellation Policy
Users may cancel bookings for a full refund if cancellation occurs at least twenty-four hours prior to the scheduled service time. Cancellations made less than twenty-four hours prior to the scheduled service time may be non-refundable. BeThere reserves the right to issue refunds at its discretion.
8. Assumption of Risk
You acknowledge that participation in services and experiences involves inherent risks. You voluntarily assume all risks associated with participation in services booked through the platform. BeThere shall not be liable for injuries, damages, or losses arising from participation in third-party services.
9. Artificial Intelligence Services
The platform may include artificial intelligence features designed to facilitate communication and recommendations. Such features are provided for convenience only. BeThere does not guarantee the accuracy or reliability of artificial intelligence outputs.
10. Intellectual Property
All software, technology, content, and materials associated with the platform are the exclusive property of BeThere Group Inc. Unauthorized copying, modification, or distribution is prohibited.
11. Disclaimer of Warranties
The platform is provided on an as is and as available basis. BeThere disclaims all warranties, express or implied, including warranties of merchantability and fitness for a particular purpose.
12. Limitation of Liability
To the maximum extent permitted by law, BeThere Group Inc. shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or personal injury arising from use of the platform.
13. Indemnification
You agree to indemnify and hold harmless BeThere Group Inc. from claims arising from your use of the platform, violation of these terms, or interaction with third-party providers.
14. Force Majeure
BeThere shall not be liable for failure or delay resulting from causes beyond its reasonable control, including natural disasters, technical failures, government actions, or provider cancellations.
15. Arbitration and Dispute Resolution
Any dispute arising from these Terms shall be resolved through binding arbitration in the State of Florida. You waive the right to participate in class action lawsuits.
16. Governing Law
These Terms shall be governed by the laws of the State of Florida.
17. Termination
BeThere may suspend or terminate access to the platform at any time without notice.
18. Modifications
BeThere reserves the right to modify these Terms at any time. Continued use of the platform constitutes acceptance of modified Terms.
